随着市场化改革的推进,航空市场自然垄断性不断弱化,垄断协议行为凸显。作为民用航空运输大国,我国民航领域的反垄断研究尚需加强。为防止和纠正横向垄断协议问题,需考量中国反垄断的基本立场及自身民航发展的经济需求等因素,健全民用航空领域竞争性市场的保障制度需要完善相关行业性法律法规体系、明确政府监管职能、完善行业监督机制,结合新《反垄断法》确立竞争政策和公平竞争审查制度,建立民航市场垄断协议及其豁免情形的规制机制。

As market-oriented reform progresses,the natural monopoly in the aviation market is continuously weakening and monopoly agreement behavior is becoming increasingly prominent.As a major country in civil aviation transportation,China's civil aviation industry's research on legal issues still requires to be further studied.To address the issues of horizontal monopoly agreements,it is necessary to take into account factors such as China's basic stance on antitrust and its own economic needs for the development of civil aviation.To enhance the protection system for the competitive market in the civil aviation industry,it is necessary to improve relevant industry laws and regulations,clarify government regulatory functions,improve industry supervision mechanisms and establish a regulatory mechanism for monopoly agreements and exemptions in the civil aviation market in conjunction with the competition policy and fair competition review system established in the new AntiMonopoly Law.
